Thomas M. Wester

With an accomplished practice focused on representing insurers in the investigation and litigation of complex insurance matters, Thomas Wester has extensive experience handling a variety of issues including commercial disputes, construction accidents and defects, trucking and transportation accidents, premises liability, and property damage. He previously served as special coverage counsel to major insurers defending first-party property claims.
Mr. Wester has extensive knowledge and experience representing clients in New York, New Jersey and Pennsylvania state and federal courts through all aspects of the litigation process. Additionally, he regularly and successfully counsels and provides written opinions to primary and excess level insurers concerning a range of coverage issues.
With valuable first-hand experience in a variety of insurance matters, Mr. Wester has been called upon to speak and lecture to peers and insurance industry leaders on topics such as first-party property claims, the tri-partite relationship, and claims-handling, and has also written about states’ expansion of private causes of action for bad faith.
Prior to entering private practice, Mr. Wester completed a clerkship with the Hon. Thomas R. Vena, J.S.C. at the Superior Court of New Jersey.

- Successfully defended insurer at the trial and appellate levels against claims that insurer was estopped from disclaiming coverage to commercial waste removal company
- Secured judgment of no coverage obligation on behalf of insurer in environmental action following a multi-day, binding arbitration
- Achieved dispositive ruling of no coverage obligation for a marine insurer in a complex multi-jurisdictional coverage dispute arising from the alleged partial sinking of a multimillion-dollar yacht, which ruling was affirmed in a precedential opinion on appeal
- Served as special coverage counsel to major insurers in connection with catastrophic weather-related claims
- Defended multiple insurers in hundreds of lawsuits in state and federal court alleging violations of the New Jersey Consumer Fraud Act, bad faith denial of coverage, and first-party property damage as a result of Superstorm Sandy
- Achieved dispositive ruling of no coverage for automobile insurer against an unlicensed individual who drove a friend’s car without a reasonable belief that she was entitled to do so
